Are you trying to avoid bankruptcy and creditors have you down and out? Are you trying to avoid the inevitable and yet a bankruptcy is more than likely going to be your only way out? Do creditors call you every day with the latest and greatest threat of the day? If so, then it is time you have your own latest and greatest threat of your own. The threat of bankruptcy.

If creditors are persistent and are growing with their frequency in the number of calls they make to your home per day, then you need to tell them politely that you appreciate them reminding you of your debt for the second or third time today but you will have to get back with them later in the week because you are gathering information on bankruptcy. While no one wants to throw around false statements, if you are really trying to avoid bankruptcy and you are currently trying to find a better financial way out of your mess, then you need a few days to clear your head without the threat of someone breathing down your neck trying to make you go stir crazy in the process. So, tell the creditor you are considering bankruptcy and you will have to get back with them when you make a decision. If they give you any grief, then just pause and then tell them, on second thought maybe they should just talk with your bankruptcy attorney because you are ready to file at this moment or maybe, once again, as you requested earlier they could back off for a moment so you can have time to think everything over before making a final bankruptcy choice.

Creditors are often very pushy and in fact they may be pushy until you throw out a threat of bankruptcy. This may put a clear stop to the calls and the mail for at least a few days. It will certainly give them time to think about if they have indeed been calling your home with too much frequency. Creditors don't want to have their customers filing bankruptcy on them and if you ask for a deferred payment while you are trying to avoid bankruptcy, then you may just receive one or two just so the creditor can give you some support while they cross their fingers that you won't file bankruptcy on them.

Creditors do recognize that the new bankruptcy law will protect them somewhat but since they don't know each and every element of your financial situation, it is likely they will become concerned when they hear words such as bankruptcy lawyer, bankruptcy information and filing bankruptcy. If you need just a little breathing room, then throw your weight around by throwing out the B word. You may be surprised at the power the word brings when you are dealing with creditors who don't want you to file bankruptcy on the outstanding debt you owe to them!
