Used to be that it was pretty easy to calculate when you should consider bankruptcy as an option for you and your family. It was simple because it was made to be that way and in fact, anyone who wanted to file bankruptcy could file bankruptcy. It really was that simple. However, things have changed and now it may be much more difficult to file bankruptcy in the United States than ever before in the history of the US.
Even though the laws and restrictions make it much more difficult to file bankruptcy than in years past, there will still be many people who will need to file in order to eat so here's a checklist of items for you to consider when you are thinking about filing for bankruptcy. The following items won't guarantee you are a likely candidate but they may help you realize whether or not you need to see a bankruptcy attorney for further advice.
- Do you have creditors beating down your door for their money? If you do and you realize it is going to get a lot worse before it gets better, then you may be a candidate for bankruptcy? Especially if it so bad the creditors are literally knocking on your door.
- Do you owe more minimum payments per month than you bring in each month? Is there any way you can talk to someone who can help you lower your minimum payments so you can meet your credit obligations? If not, then you may have no choice but to file bankruptcy.
- Do you feel ashamed every time you walk into the bank because you have so many outstanding debts that your checks are always bouncing because you give out checks to your creditors just to get them off of your back?
- Do you avoid answering the phone because it's just a bill collector anyway?
- Did the person you talked to at the Debt Counseling Center tell you there was nothing she could do for you and advise you that if she were in your shoes, she would file bankruptcy?
If one or more of these things are really starting to get you down, then it is time you talked to someone about filing bankruptcy. No, it isn't the end of the world if you just talk to a bankruptcy attorney.
However, it is possible that they won't be able to do anything for you under the new bankruptcy laws. Still, many of them can offer you some advice that may help you get creditors off your back and keep them off of your back!

October 17, 2005 saw the new guidelines to the bankruptcy code. Since the large amount of debt was beginning to cause a strain on the economy, these changes were long overdue because of the widespread abuse of the system. The new code and guidelines strive to change irresponsible behaviors and discourage the number of bankruptcy filings without an investigation into the circumstances surrounding the event.
