There are a couple of major decisions that you are going to have to make when it comes to filing for bankruptcy but one of the most important is whether to file for Chapter 7 bankruptcy or Chapter 13 bankruptcy. Chapter 7 bankruptcy is the most commonly filed for, and there are a few things about it that one needs to be aware of before going through with it.

Chapter 7 Bankruptcy

This type of bankruptcy is also known as liquidation and is one of the most common sorts of bankruptcy filings that a person goes through for. This type of bankruptcy will work to cancel your debts but bear in mind that you might have to let the bankruptcy court liquidate or sell some of your property for the benefit of your creditors.

This is often the case because when a person owes so much to creditors they cannot just claim bankruptcy and expect the money that they owed to be forgotten about. Therefore, often times the person will have to give up some of their assets such as their home or car, in order to cover some of the debt that they owed.

Chapter 7 bankruptcy if you want to file for it, can be quite a complex process but as long as you have a good idea about what you are doing you should not have any problems. First you want to analyze your debt, figure out just how much you owe and to who. Now you want to make sure that you have no other way out, that maybe if you got an extra job or saved some money that this would not be enough and save you from having to file for bankruptcy.

Now you want to make sure that you are actually eligible to file for Chapter 7 bankruptcy. If you are, you can start filling out the forms and go to a meeting so that you can learn more about it and see what your next move is going to have to be. File objections or motions if needed, and wind up your secured debts.

Now you are going to need to get your discharge and you are pretty much done. If you are not super comfortable dealing with this financial issue on your own you may want to get someone to help out.
